European Commission publishes draft on reporting discarded consumer products (ESPR)

The European Commission has published the Implementing act on the format for reporting of discarded unsold products, as part of the Ecodesign for Sustainable Products Regulation (ESPR).

This draft outlines the structure, content, and verification process for disclosures required, which prohibits the destruction of unsold consumer goods in certain categories, including textiles and footwear.

Key points include

  • Reporting obligations for large enterprises on the number, weight, and reasons for discarding unsold products.
  • Required disclosure of waste treatment methods and preventive measures taken. Exemptions for micro and small enterprises, with medium-sized enterprises subject to the rules six years after entry into force.
  • The regulation will enter into force 20 days after publication in the EU Official Journal, which is expected shortly.

UKFT will continue to closely monitor regulatory developments and will provide further updates following the publication and adoption of the final delegated and implementing acts. Once the requirements are confirmed, UKFT will produce detailed guidance to support industry compliance.
