California’s Proposition 65 Short Form Warning Update

The California Office of Environmental Health Hazard Assessment (OEHHA) has updated the Proposition 65 (Prop 65) regulations for “short-form” warnings. These amendments, approved by the Office of Administrative Law (OAL) on November 26, 2024, aim to make the warnings more informative for consumers and will become effective on 1st January 2025 and compliance is required by 1st January 2028.

Key changes include:

  1. Inclusion of Chemical Name: Short-form warnings must now include at least one chemical name for each applicable endpoint (e.g., cancer or reproductive toxicity).
  2. Options for Warning Language: Businesses can use “WARNING,” “CA WARNING,” or “CALIFORNIA WARNING” to identify the warnings as California-specific.
  3. Label and Font Size: The text must be at least 6-point font and conspicuous compared to other text on the label.
  4. Method of Transmission: No changes were made to the methods of transmission, but businesses are encouraged to ensure the warning is received before purchase and exposure.

 

These updates are intended to enhance transparency and provide consumers with more detailed information about the risks associated with exposure to listed chemicals.
